Caldwell Co., MO — Driver Killed in Two-Vehicle Crash on Old US 36 Near Cameron
Caldwell County, MO (March 3, 2026) — A tragic collision on Old US Highway 36 claimed the life of a 40-year-old man on Monday afternoon, March 2. The Missouri State Highway Patrol responded to the scene at the intersection of Joe Montana Drive, approximately two miles east of Cameron.
According to the official crash report, the accident occurred as a 2023 Ram Transit Van was traveling northbound on a private drive. As the van attempted to turn west onto Old US Highway 36, it traveled directly into the path of an eastbound 2008 Ram 2500 pickup truck. The pickup truck struck the van in the eastbound lane of the highway.
The force of the impact sent the transit van off the north side of the roadway, where it came to rest facing west. The Ram 2500 traveled off the south side of the road and overturned before coming to rest on its wheels, facing north. The driver of the pickup truck, a 40-year-old male, sustained fatal injuries and was tragically pronounced deceased at the scene.
Troopers are continuing to investigate the crash.
We extend our sincere condolences to the family of the person who lost their life.
What Are Your Rights After a Fatal Accident in Missouri
In Missouri, when a family member is killed in a crash, there are two distinct ways to seek accountability: a Wrongful Death claim and a Survival Action. A Wrongful Death claim is for the family’s own losses (like emotional support and funeral costs), while a Survival Action seeks compensation for the pain and suffering the deceased experienced before passing. Missouri law has a strict three-year deadline for most of these claims.
Missouri Revised Statutes sets a specific "priority list" of who can lead a legal claim. Only one wrongful death action can be brought against a defendant for a single death, and the right to file follows this hierarchy:
- Class 1: The surviving spouse, children (or grandchildren), and the parents of the deceased.
- Class 2: If no one in Class 1 exists, the right passes to the deceased’s siblings or their descendants.
- Class 3: If no relatives from the first two classes are available, the court can appoint a "Plaintiff Ad Litem" to represent the interests of those entitled to share in the recovery.
It is important to understand that these are two separate legal tools that often work together. A Wrongful Death claim focuses on the survivors, covering "pecuniary" losses like funeral expenses and the loss of the victim's future earnings and companionship. A Survival Action is filed on behalf of the deceased's estate. It covers the damages the victim could have sued for had they lived, specifically the medical bills incurred after the crash and any conscious pain and suffering they felt before they died.
In cases involving extreme recklessness, Missouri allows for "aggravating circumstances" damages. These are similar to punitive damages and are intended to punish the at-fault party rather than just compensate the family. This is particularly relevant in commercial vehicle accidents (like those involving transit vans), where the focus is on holding a company accountable for the actions of its driver.
