Tennessee Drunk Driving Laws

In Tennessee, the legal limit is a blood alcohol content )BAC) of 0.08%. If a motorist tests for this or above, they are considered driving under the influence.

For people under the legal drinking age of 21, the state has a "zero tolerance" policy. This means that if someone under 21 has a BAC of 0.02% or more while driving, they can be charged with a DUI—even if they aren’t actually drunk.

Tennessee has strict penalties in place for offenders. First offenders face mandatory jail time of at least 48 hours—if your BAC is 0.20% or higher, the minimum is 7 days. The maximum penalty is up to 11 months and 29 days in jail and/or a fine of up to $1,500. Your license can be revoked for a full year and you must attend an alcohol and drug treatment program.
