Tennessee is known for being the home to countless music legends, and Nashville is often referred to as the capital of country music. Unfortunately, the state is also known for being the worst state in the country with regard to distracted driving accidents and fatalities. In 2019, over 3,100 individuals lost their lives in car accidents caused by distracted driving. In Shelby County alone, there were over 3,000 distracted driving crashes in the year 2020. While there have been laws passed over the last few years to combat these troubling numbers, distracted driving is still an issue and contributes to many injuries and deaths. If you’ve been injured by a distracted driver, you may be able to cover your losses by filing a claim.

What is Distracted Driving?

Distracted driving involves the act of driving while also doing other activities that take your attention away from the road and your surroundings. People often associate visual distractions such as phone screens with distracted driving, but there are actually three forms of distracted driving.

Distracted driving can be:

  • Visual: Visual distractions involve anything that prevents a driver from looking at the road ahead of them and can include texting, looking at a GPS, or watching a movie or video.
  • Cognitive: A distraction is cognitive when a driver’s mind isn’t focused on driving or the road. This means that a driver can still be distracted and make mistakes or cause accidents even when their eyes are focused on the road ahead of them. Examples include having conversations with other passengers in the vehicle, talking on the phone, listening to music, or even thinking about stressful or worrisome issues.
  • Manual: Manual distractions involve taking your hands away from the wheel, even if only for a moment. Examples include drinking or eating while driving, applying makeup, holding a device or phone, or reaching backward for something. Even adjusting the volume on your radio can be considered a manual distraction.

Distracted driving is more of an issue than ever thanks to the amount of technology out there. Millions of Americans have access to games and apps on their smartphones and other devices they can take with them on the go. Unfortunately, operating these devices while driving can contribute to serious accidents like rear-end collisions, which occur when one car fails to stop or slow drown and collides into another car from behind.

Tennessee’s Distracted Driving Laws

Tennessee has a variety of distracted driving laws, including a more recent cell phone usage law, that results in fines and penalties should anyone break them. The state uses primary enforcement, meaning if you’re witnessed texting or showing signs of distracted driving, a police officer can pull you over and issue a fine, even if you weren’t doing any other illegal activity such as speeding.

In our state, it’s illegal to:

  • Hold a cell phone or any other mobile device with any part of your body
  • Record or broadcast a video or movie on your phone or some other device
  • Write, send, or read any text messaged
  • Use cell phones when others are on the bus if you’re a school bus driver
  • Use any cell phone, even hands-free, if you’re under the age of 18 or have a learner’s permit or intermediate driver’s license

How We Can Help

It can sometimes be complicated to establish liability after a distracted driving accident. At-fault drivers might claim they weren’t doing anything when the accident occurred and lie in order to evade responsibility. Their insurance company might also attempt to shift some of the blame onto the victim to avoid paying damages.

However, our Memphis distracted driving accident attorneys know all the tricks that negligent parties use to avoid taking accountability for their actions and have the experience and resources needed to protect your rights to compensation. We can access the driver’s cell phone records, crash reports, witness statements, and more to strengthen your claim.

We can fight to maximize your recovery so no matter whether you have medical bills, damage to your car, or other expenses, you can rest assured knowing we are committed to ensuring you don’t have to pay a dime.
