Helping Victims of Rideshare Accidents Seek Fair & Just Compensation in Milwaukee, WI

As more and more people rely on Uber, Lyft, and other rideshare companies to get around, the risk of being involved in an accident with one of these drivers has simultaneously increased. Rideshare drivers are not technically professional drivers; there are no required trainings or safety certifications for someone to work for one of these companies. Rideshare drivers may cause accidents when they are distracted looking for a passenger, driving in an unfamiliar area, or reacting to changing road conditions.

Although our Uber and Lyft accident law firm has helped many individuals seeking compensation after a rideshare accident, we understand that each situation is different, and our lawyers work tirelessly to ensure that each case received the individual attention that it requires.

If you were involved in an Uber or Lyft accident—whether as the passenger of the Uber/Lyft, the driver of another vehicle, or as a bicyclist or pedestrian—you may be entitled to compensation for your damages. The amount of compensation you may be able to receive will depend heavily on the circumstances surrounding the accident and, in any case, these claims tend to be very complex. We encourage you to reach out to our Milwaukee Uber and Lyft accident lawyers to discuss your legal options during a free consultation.

Who Pays for an Uber/Lyft Accident?

Like any car accident case, Uber and Lyft accident claims depend on liability. Determining who is liable for the accident will determine who you should file a claim against, as well as how much compensation you may be entitled to receive. Note that liability is not the same as fault; liability is a legal issue regarding who is responsible for compensating personal injury victims. Because neither Uber nor Lyft classify their drivers as “employees,” they are not technically liable when their drivers cause accidents.

However, both Uber and Lyft do offer insurance coverage for accidents.

Uber and Lyft offer the following coverage in the following situations:

  • If the rideshare driver does not have the app turned on and has not accepted a ride, the rideshare company is not liable. To recover compensation, you will need to file a claim with your own insurance provider or with the at-fault driver’s insurance provider, just like any other type of car accident claim.
  • If the rideshare driver has the app turned on but has not yet accepted a ride, Uber/Lyft will cover up to $50,000 per person in bodily injury coverage, up to $100,000 per accident in bodily injury coverage, and up to $25,000 per accident in property damage (this does not include damage to the rideshare driver’s vehicle).
  • If the rideshare driver has the app turned on and has accepted a ride or has a passenger in the vehicle, Uber and Lyft offer up to $1 million in liability coverage.

This coverage only kicks in once the driver’s own auto insurance coverage has been exhausted. So, after an accident, you will first need to seek compensation through the Uber/Lyft driver’s own auto insurance policy and, once this coverage has reached its limit, you may seek additional compensation through Uber/Lyft’s policy.

Can I Sue if I was in an Accident with an Uber or Lyft Driver?

As the victim of this accident, whether you are the passenger or another driver, you can sue Uber or Lyft. There are a number of legal routes to pursue, however, which is why you should work with an attorney to determine the best possible route for your particular case. Our firm can analyze your case and help you seek a maximum settlement that covers the cost of your injuries and other damages suffered.

How Can An Uber Accident Attorney in Milwaukee Help?

After an accident, your focus should be on getting proper medical treatment and taking care of yourself so that you can recover and move forward with your life. You shouldn’t have to worry about how you are going to pay for your medical bills and other expenses or about proving who is responsible for your damages.

An Uber and Lyft accident attorney can help you in the following ways:

  • Maximize Compensation: Having an attorney is extremely important for helping to ensure that you receive the full compensation amount that you are entitled to. Without a lawyer, you may be risking your compensation amount.
  • Representation: Your rideshare accident attorney will advise you as to whether you should take your case to court. If it is beneficial for your case, then your attorney will be there to represent you in trial and fight for a favorable settlement on your behalf.
  • Negotiation: You will need a professional to effectively negotiate with insurance companies for you. Your attorney will know the ins and the outs of the law and the legal system, and will be able to fight for you.
  • Support: Your attorney will be there to serve as an emotional support system for you during this difficult time. There are probably a lot of different aspects that you will need help with, and your lawyer will be by your side through it all.
  • Information: Your attorney will be there to answer all of your questions and will provide you with important legal information to help ensure that your rights and your future are efficiently protected.
